You are required to electronically sign the following Vacation Rental Agreement. The Docusign agreement will be sent to you after providing an email address after booking. The agreement must be signed within 48 hours after booking if you are within 30 days of the check-in date.

We, the Renters (also referred to as “Tenants” and “Guests”) agree to the following:


PAYMENT DUE – All rental monies are due according to the payment schedule terms disclosed through the portal in which the home was booked. (ie. AirBnB, VRBO, Expedia, etc.)
CANCELATION POLICY - Cancelation policy is stated in the portal in which the home was booked. (e.g. AirBnB, VRBO, Harvest Ridge Ranch.) For direct booking, a full refund if canceled more than 60 days before check-in. Cancel inside 60-30 days before check-in and we will refund 50% of the accommodation fees. There is no refund if you cancel within 30 or less days of check-in.
Advise obtaining travel insurance. There are no refunds for storms, earthquakes, pandemics or any acts of God, even if a mandatory evacuation or lockdown is ordered. (Renter may obtain 3rd party renters protection or travel insurance. Renter assumes the risk.)
ACCIDENTAL DAMAGE INSURANCE – Renters will be completely responsible for any and all damages to the home or property caused by Renters, or Renter’s guests, whether accidental or due to Renter’ negligence. Guests are required to purchase Property Damage Protection (PDP) Insurance through SafelyStay, Inc. NOTE: Your rental payment already includes PDP insurance.
TRUST AND SAFETY: The SafelyStay, Inc. Trust and Safety Property Damage Protection (PDP) Fee includes up to $1,500 of accidental coverage for contents damage and up to $100,000 coverage for accidental property damage and bodily injury. Complete terms regarding the Trust and Safety coverage can be found at http://www.safely.com. The Trust and Safety Fee is refundable only if the reservation is canceled in writing at least twenty-four (24) hours prior to the arrival date. Any deductible ($100) or minimum claim amount will be the responsibility of the Guest, and the owners will process using the form of payment on file for Guest. The PDP Fee is as follows: $94 per stay. Coverage excludes stays over 29 nights.
GUEST IDENTITY VERIFICATION: I give permission to SafelyStay, Inc., to verify my identity, and check criminal databases in order to confirm my reservation. Complete terms regarding Safely’s guest verification can be found at www.safely.com/terms. You may receive an email from Concierge@Safely.com to complete your screening. Renters understand that Renters are responsible for the damage beyond the coverage provided by the PDP. Renters are also responsible for damage that would have been covered by the PDP if Renters fail to advise the Owner or Property Manager of the damage and provide the necessary information that would allow the Owner to file a claim against the policy.
CONDITION OF PROPERTY – Owners have, to the best of their ability, given an accurate description of the property and its condition. Guest understands that it is considered as-reserved “sight unseen.” Our cleaning staff will have cleaned it before your occupancy. All electrical, plumbing and appliances should be in working order. The failures of operation of certain extra amenities, such as TVs, cable, games, or the Internet and WiFi service are not a basis for any discount or refund. Owner will make every effort to have these items repaired should they not work during your stay, but they do not guarantee that they will be repaired during Renters occupancy. When you arrive, if you find that the house was not cleaned to normal standards, guest agrees to notify the Property Manager immediately. If Owner/Property manager has not been notified within four hours of check-in, it can be assumed that the house was received in an acceptably clean state. We will do our best to have tradesmen attend to the problems but may not be able to fix everything over holidays and weekends. Under no circumstances will any of the rental money be refunded or returned because of the condition of the house. The Renter agrees to hold the Owner and Property Manager harmless from any liability for the condition of the house. Due to the nature of pool properties, concrete decks and patios may be slippery. Use at your own risk.
CLEANING & REPAIRS – All homes have cleaning added in the total rent. Please note that cleaning does NOT include dishes and cooking utensils. Cleaning does not include restoring a “trashed house”. If additional cleaning is required after you leave, it can be charged against your damage deposit or to your credit card. Renter agrees to keep the house, furniture, furnishings in good order. Removing, adding or changing furniture without Owner’s written approval shall be deemed a material breach of the Rental Agreement, and is strictly prohibited. Renter is responsible for the cost of replacement of any damage to furniture or premises and replacement of missing items not covered by PDP insurance.
CONFETTI and GLITTER, etc. Due to the difficulty of cleanup and the hazards to livestock and wildlife, confetti, glitter, bird seed, flower petals, (water) balloons, kites, flying lanterns, etc. are not permitted on the property. If such materials are found on the property, Guest may be assessed an additional $500 cleaning fee.
ENTRY OF PREMISES – With Renter’s permission, which is hereby given, Owner or Property Manager may enter the premises during reasonable daylight hours without securing prior permission from Renter, but shall give Renter ample notice of such entry immediately prior if possible and immediately thereafter. For inventory and maintenance purposes a property management employee of the Owner may need to enter the premises. The same permission procedure applies as above. In any emergency, Owner or Owner’s servicing agents may enter the promises at any time without permission of Renter for the purposes of making repairs to alleviate such emergency. If Renter abandons or vacates premises, Owner may, at his option, terminate this agreement, re-enter the premises and remove all Renter’s property
POOL TOWELS BED LINENS– The Owner has provided pool towels. They are to be used for the pool or hot tub only. Lost or accidentally taken towels will be charged at $25 per towel. Do not use bath towels at the pool or hot tub. Any unused beds will be left as found. Leave the USED beds unmade and place all used towels on the bathroom floor.
ASSUMPTION OF RISK – No lifeguard is on duty. Accordingly, persons using the pool or hot tub, do so at their own risk and the owner assumes NO responsibility for accident or injury. No one should swim alone. Renters will hold the Owners and Property Manager harmless from any and all bodily injury and/or property damage incurred on the property arising out of Renters’ negligent acts or omissions. See disclaimer below.
CHILD PROOFING – Guest understands that NO special efforts have been made to “childproof” this house and accept the risk of harm to any children they allow on the property. These risks are not limited to, but include animals, fireplace, cleaning supplies in the house and plants in the house, patio or on the street, that might be poisonous if ingested.
FURNITURE – All furniture must be returned to its original location on Guests’ departure or an additional charge will be made.
MISSING ITEMS – Renters will be charged for any missing items reasonably attributable to Renters and not returned after notification. The cleaning service performs an inventory/survey of the property after each Guest departs and notifies the Owner/Property Manager of any missing items. Property Manager will notify guest in the event that items were inadvertently taken and provide guests the opportunity to return missing items.
USE OF SECURITY CAMERAS – Renters understand and accept that the property is protected with outside security cameras. These cameras are used to protect the property from potential break-ins and theft. There are NO cameras inside the house.
TAMPERING OF SECURITY DEVICES – Renters agree NOT to tamper with any security devices including SECURITY CAMERAS, Networking Equipment, door/window monitors and WiFi Routers. Tampering includes moving, covering, obscuring, unplugging, disabling, destroying or otherwise preventing the equipment from functioning. Any indications of tampering of security devices may result in immediate eviction without refund. If Security Devices are discovered to not be working, Property Manager/Owner reserves the right to physically troubleshoot the issue immediately at the property.
PERSONAL PROPERTY – Guest understands that any personal property of and used by Guest is not insured by Owner/Property Manager and they are not responsible for any lost, stolen or missing property of the Guest or property of the Guest after checkout. If property is found, Owner/Property Manager may be requested to return items left behind by Guests at the cost of the Guests.
KEYS, CLICKERS – If any keys or gate clickers are used by the Guests and get lost, guests will incur a replacement cost of $250 for keys and $100 for gate clickers.
NO PARTIES – This is not a “party” house. The Renter must be 25 years of age to book this Vacation Rental. Any special occasions such as weddings, receptions, family reunions or increase of occupants (guests not registered on Guest List) must be disclosed at the time the reservation is made and is subject to Owner’s/Property Manager’s advanced approval. Prom parties, fraternity, sorority or bachelor parties are not allowed at any time. Adults cannot rent property on behalf of underage guests, no exceptions. Violation of the no party, no event policy will incur a $1500 penalty or immediate cancellation of the reservation without refund.
NON-SMOKING – This is a NON-smoking vacation rental. Smoking is absolutely prohibited on the entire premises, both within the house and on the property grounds. This includes smoking cigarettes, vapes, cigars, pipes or any other smoking device. Evidence of smoking such as the smell of cigarettes or cigars inside the home by the cleaning crew is sufficient basis to charge the renter for smoke cleanup and removal from carpeting, AC ducts & Filters, furniture and draperies. Violation of the no-smoking policy will result in forfeiture of the full security deposit and damage liability of up to $2,500 for any discovered damage to furniture or odors.
NO PETS - This is a ranch with vulnerable farm animals. Absolutely NO pets or service animals are allowed at this property at any time. If an unauthorized pet is on the premises, the guest will be assessed a fine of $1000, and will be asked to remove the pet or leave immediately without a refund. Damage or cleaning attributable to pets shall be the responsibility of the guest.
MAXIMUM OCCUPANCY - The maximum occupancy for this home is 14 people. Please adhere to this rule. If there are more people than allowed to sleep in this home, you will be fined an additional fee of $250 per additional person. Infants under the age of 2 are not counted.
PARKING – Parking is limited to 6 vehicles on the left side of the house in the designated parking area. Additional vehicles in excess of 6 vehicles at any time will incur a fee of $100 per vehicle, per day of violation.
SUBLETTING – Guest is not authorized to let or sublet all or any part of the premises nor assign the lease or any interest in it without the prior written consent of the Owner/Property Manager.
AIR CONDITIONING (A/C): Setting the A/C temperature very low will not speed up cooling of the house. Guests agree that at no time will the A/C temperature be set below 68 degrees. If the temperature is set too low the A/C unit coils will freeze and prevent the system from cooling the house. This can incur expensive HVAC repair fees to troubleshoot and remedy the situation which guests will be responsible for. There is no guarantee that the situation can be remedied during the remainder of Guest stay and no refund will be provided for loss of A/C caused by guest setting the thermostat below 68 degrees.
Guests further agree to responsible use of the A/C HVAC system. All windows and doors to the exterior shall be closed when A/C or Heat is used.
If a certain room is too hot or too cold but HVAC system needs to be on for the house, guests may close the vent and door to that room.
CHECK-IN & CHECKOUT – Check-in is at 4PM and checkout is at 10AM. An unauthorized late checkout is subject to extra rental charges at the rate of $100/hour after a 30-minute grace period. Guests may arrange for an additional night in advance to avoid any late checkout fees. Extra nights are charged at the daily rate and may be granted if available. Late check-out or early check-in must be arranged with the Property Manager in advance to avoid any late checkout fees. Please checkout promptly, the cleaning crews have a very short time window to prepare the home for the new guests.
CHECKOUT PROCEDURES – Renters are responsible to complete the checkout procedure provided in the Red Welcome Book.
ATTORNEYS FEE/DEFAULT – If any legal action or proceeding (including defaults, non-payments, etc.) arising out of or related to the Rental Agreement is brought by either party to this Rental Agreement, the prevailing party shall be entitled to receive from the other party, in addition to all other relief that may be granted, the reasonable attorney’s fees, costs and expenses incurred in the acting or proceeding by the prevailing party.
INDEMNIFICATION – Guest agrees to indemnify and hold harmless Owner/Property Manager for any liability arising before termination of this Rental Agreement for personal injuries or property damage caused by the negligent, willful or intentional conduct of Guest(s). This indemnification agreement does not waive Owner’s/Property Manager’s duty of care to prevent personal injury or property damage when that duty is imposed by law.
PRIOR AGREEMENTS – No prior agreement or understanding not contained in writing herein shall be effective. Furthermore, Owner, other than what is specifically written and set forth herein, makes no other or further representation regarding the nature, character and quality of the premises to be rented, and no representation shall be deemed to exist or be material unless and until it is reduced in writing only, and must be signed by the parties in interest at the time of the modification. It constitutes the entire agreement of the parties. If any provision in the agreement held by any court to be invalid, void or unenforceable the remaining provisions shall nevertheless continue in full force.
FORUM SELECTION, JURISDICTION, LAW AND VENUE – The parties agree to the exclusive jurisdiction and venue of the Superior Court of California, County of San Luis Obispo for the resolution of all disputes arising under this Agreement. The sole and exclusive venue (i.e. Place where lawsuit may be filed) for any legal proceedings shall be in the County of San Luis Obispo, California. Guest expressly waives any other right or privilege with respect to the election of venue or court (ie. State or Federal) and location of the venue of action.
GOVERNING LAW – It is expressly agreed that this agreement shall be governed and construed by the laws of the State of California, irrespective of the state of residency of the Guest.


Disclaimer:
Renters understand that the Owners/Property Manager are not responsible for any personal injury caused by slipping on wet pavement or surfaces, and that tenants are responsible for exercising care when surfaces are wet or slippery due to weather or use of hoses to wash down areas, and further, that the Owners/Property Manager are not responsible for any personal injury or loss or damage to tenants’ property caused directly or indirectly from foul, inclement weather conditions. Acts of God or nature, failure of heat, accidents related to fire, floods, heaters, stoves, tenants’ failure to take adequate precautions around wet areas, or any unforeseeable circumstances.
Under no circumstances will Renters or their guests hold the Owners/Property Manager responsible for any damages or claims of any kind resulting from their stay, except for intentional acts of harm.


This agreement and disclaimer is applicable to Renters and all guests in the Renter’s party.

I agree for myself and members of my family, friends, or any other third parties under my supervision, to the following:


AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions of directions given by the owners, employees, representatives or agents of the owners of 280 Harvest Ridge Way, Paso Robles, CA
ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, friends or other third parties under my supervision, and further release and the owners of 280 Harvest Ridge Way, Paso Robles, CA , for injury, loss or damage arising out of my, my family, or other third parties use in our presence of the facilities at 280 Harvest Ridge Way, Paso Robles, CA, whether caused by the fault of myself, my family or other third parties.
INDEMNIFICATION. I agree to indemnify and defend the owners of 280 Harvest Ridge Way, Paso Robles, CA against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from me, my family, or other third party’s use of or presence upon the facilities of 280 Harvest Ridge Way, Paso Robles, CA
FEES. I agree to pay for all damages to the facilities of 280 Harvest Ridge Way, Paso Robles, CA caused by any negligent, reckless, or willful actions by me or my family, friends, or other third parties under my supervision.
APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under California law.
NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I do so desire.
ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.
DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.


Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law.


This agreement and disclaimer is applicable to Renters and all guests in the Renter’s party.

The space
This is a NO PETS home.

There is usually a groundskeeper on the property who is either there or a phone call away in case of emergencies.

You're in the middle of wineries and vineyards with gorgeous vistas, yet just 5 minutes to downtown Paso Robles.

Guests get the whole house to themselves. No garage access and maximum number of vehicles allowed on the property is 6.

THE IMMEDIATE AREA

Located in the heart of Eastside Paso wine country, this home is surrounded by acres and acres of vineyards and “great find” wineries. Walk to neighboring Rasmussen (0.2 miles) for free wine tasting on weekends. Stop by Sculpterra (0.8 miles) for wine tasting, food options and entertainment. Or jump in the car and head to Dresser Winery (1 mile). Venture out further and explore the other 200+ wineries, local craft breweries and distilleries in the Paso Robles AVA.

You'll need a car to get around.

SLEEPING BATH ACCOMMODATIONS

Five bedrooms (two with en suites – on the first floor) and two stories give plenty of room and sleeping accommodations for your large group.

On the first floor, the spacious master suite features a California King bed, a queen sleeper sofa, working desk, 50" Smart TV and direct access to a private raised bed garden area. The en-suite bathroom has a double vanity and a tiled walk-in shower with smooth river rock floors.

The pool room serves as a second master en-suite which features a queen bed, a queen sleeper sofa, a working desk and 48” TV. This room has direct access to the pool area. The en-suite bathroom has a large walk-in shower and a combo washer/dryer.

A third bathroom downstairs has a stand-up shower and is also used as the guest bath for your group and guests.

Upstairs, the third bedroom, also a game room, has a full-size bed, a twin-over-queen bunk bed, and a twin daybed, along with 42” TV with XBox360.

A fourth bedroom has a queen bed, and a fifth bedroom has two twin-size beds. The upstairs (fourth) bathroom has a shower over tub and three pedestal sinks allowing everyone to get ready at the same time!

LIVING ENTERTAINING SPACES (Interior)

Gather in the large, comfortable living room (on the main floor) furnished with an oversized sectional, a love seat, and a comfy armchair with an ottoman. The 50” TV is equipped with a Blu-ray player. There is a multi-station USB charger to take care of keeping your electronics charged up. Use the Central Air Conditioning system to escape the Summer heat. In the Winter, use the ceiling radiant heat and wood-burning fireplace to take the chill out of the air during the cooler Paso nights. An assortment of books, magazines and board games are provided for unplugged entertainment.

All TVs are wifi-enabled and pre-configured to access VUDU with a 150+ title movie collection. Guests may connect to their own streaming services using the provided wifi and these smart TVs.

The enormous full-stocked gourmet kitchen will be the envy of the chefs in your group. Outfitted with all group sized stainless steel appliances including a 6-burner Dacor stove top, Dacor double wall ovens, two dishwashers, and full size freezer and separate full size refrigerator that will make feeding the crowd a breeze.

Guest amenities include complimentary Wi-Fi, all bed linens, bath towels, pool towels, and parking for up to six cars to the left side of the house. Park 90 degrees along the black gate (to the left of the house) and not on the black driveway or anywhere in front of the house. Pool is solar heated only between mid-April and mid-October, depending on the weather. Also, please keep in mind that you will be out in the country so there is the occasional sound of gunfire which can be heard from the property.

PLEASE NOTE: Minimum age required to reserve is 25 years of age or older. Booking this property requires a separate signed rental agreement and a fully refundable $1000 security deposit prior to arrival. The security deposit will be collected directly by the property manager. The deposit will be returned within two weeks after checkout provided there are no damages (or incidentals) in excess of the damage insurance coverage or any violations of the rental agreement. A valid government-issued photo identification will be required BEFORE CHECKIN that must match the name on the reservation.
Guest access
Guests will have access to the entire house and the fenced in area around the house including pool and patios. Parking is provided for up to 6 vehicles along the side of the fence.
Additional notes
You must be 25 years of age to reserve and stay at this property. Pets are not allowed. No smoking is allowed. The cleaning fee covers a one-time departure clean and includes damage protection fee that provides limited protection in the case of unintentional and accidental REPORTED damage to the property.
Guest interaction
The local property manager will send you information on how to contact them if you need assistance prior to or during your stay. They will also send you arrival instructions, which will include how to access the property. If required, the property manager will send a rental agreement that should be signed and returned.
Neighborhood overview
We're out in the country and our neighbors are other ranches and vineyards. The property is very private except for the caretakers who may be out and about doing farm/ranch chores.
